Valencian legislation for holiday lettings – what do you need to know 

On August 7, 2024, the Valencian Government  approved Decreto Ley 9/2024, introducing significant changes to the regulation of viviendas de uso turístico or tourism lets. These modifications aim to increase control, improve tourism quality, and address housing issues caused by short-term rentals. If you own a holiday rental, it’s essential to understand these changes to avoid penalties and ensure your property remains compliant.

What is now considered a Tourist Let ? 

According to the new Valencian legislation for holiday lettings, a “vivienda de uso turístico” is defined as a fully rented property, that is:

  • Leased for a period of 10 days or less to the same tenant.
  • Registered with a favorable municipal compatibility report confirming its suitability for tourist use.

A key change in the law is that renting out individual rooms is strictly prohibited—only entire properties can be legally used as short-term tourist rentals. Additionally, every rental contract and registration must include the property’s unique cadastral reference number.

A property will be presumed to have a tourist purpose if :

  1. The property is managed by a registered tourist rental agency.
  2. It is rented directly by the owner for tourist use, with or without hotel-like services.
  3. It is advertised on tourist marketing channels.

Does this mean I can no longer rent my property for more than 10 nights?

No, you can still rent your property for stays longer than 10 nights. However:

  1. These stays will not be classified as tourist rentals and will be subject to different regulations.
  2. You must declare to the Tourism Office which periods your property will be for tourist lets and which will be for long-term rentals—you cannot offer both services simultaneously.

For example, you could designate July and August for short-term tourist rentals while using the rest of the year for long-term lets. This must be clearly stated in the information linked to your tourist rental license. You can edit this information throughout the year via the AUTOREGISTRO access to your licence ( you will need a digital certificate). 

Tourist rental licenses will be valid for five years, subject to compliance with minimum standards for design, quality, safety, accessibility, and equipment. 

Key new Requirements for a Tourist Rental in Valencia

These are some of the key minimum standards your tourist rental must meet to be compliant with the new regulations in Valencia.

If your property is part of a community of owners or a building, you will need to obtain authorization from the community. This authorization must be provided as proof when submitting your license application.

Elevator required in buildings over 4 floors (excluding the ground floor).

Check-in service

Facilities and Services:

Heating and air conditioning in living/dining room

First-aid kit & emergency phone numbers

Regular cleaning service and linen change.

The Hospedaje Declarations

Previously, the Guardia Civil was handling the registration of travellers, but this process has now shifted to a national platform : Hospedaje. Property owners and agencies must now follow two key steps:

1. Declare each booking as soon as it is confirmed. This includes providing details such as the guest’s name, passport number, address, country, payment method, and total price.

2. Register every guest upon check-in. This includes collecting and submitting full information for each party member aged 14 or older, such as ID, name, nationality, gender and address. For underage guests, the relationship to the main guest has also to be specified ( parent, friend etc). 

Both steps are now mandatory to ensure compliance with the updated registration process.

The new “ventanilla única digital de arrendamientos” Registration

This is a new centralized digital platform designed to simplify the registration and regulation of all rental properties in Spain, whether for short-term, long-term, or both. Digital platforms will also have to periodically share rental data to prevent irregularities.

The new system will be mandatory from July 1, 2025. The registration process is straightforward and can be handled by your gestor or accountant. Requirements may vary depending on the Land Registry office where you submit your application, but you will typically need to prove property ownership, and provide details of your Tourism Licence. Once registered, you will receive a unique identification number, which you must  include in all online listings related to your rental.
